On July 22, 2010, Chairman Bobby L. Rush and Henry A. Waxman proposed the Hazardous Chemicals Safety Act H.R. 5820. The legislation will amend the TSCA, introduced in 1976, to ensure that the public and the environment can avoid exposure to hazardous chemicals. To protect the public and the environment, the draft establishes a framework to ensure that all chemicals that the US public may be exposed to must pass a safety review and, if necessary, limit the use of these chemicals. For the US Environmental Protection Agency (EPA), the draft establishes a rapid way to reduce exposure to persistent, bioaccumulative and toxic chemicals while allowing exemptions for certain known safe substances. According to the measures proposed in the draft, the EPA's actions will accept open and transparent public comments and be subject to judicial review to avoid unreasonable procedural burdens. The result is a draft submitted today that will protect public health and the environment while promoting employment and innovation in the United States. According to this legislation, the safety of all chemicals will be reviewed, hazardous chemicals will be restricted or eliminated, and new safer chemicals will be developed more rapidly, pushing our economy into a sustainable future.
In the past two decades, many regulatory obstacles have made TSCA often unable to perform effectively, so more and more consensus TSCA should be revised. In the past year, the EPA and other stakeholders, including the American Chemical Society and the broad alliance of public health, labor, and environmental groups, have issued key principles that list the priorities for legislative reform. In addition, many other stakeholders have also expressed their views on how to reform the toxic substance control law.
Recently, the House Energy and Commerce Committee will vote on the Toxic Chemical Safety Act to protect the public from hazardous chemicals.
